Plaintiff Maria Tavey Umhey (“Umhey”), a former Orange County Legislator, brought this action seeking damages under 42 U.S.C. § 1983 for pain, suffering, humiliation and embarrassment she suffered as a result of attempts by defendants Orange County and the Orange County Board of Ethics (“the County”) to compel her to produce her husband’s tax records pursuant to a provision of the County Code of Ethics later held unconstitutional by the Supreme Court of Orange County.
