The defendant's in error brought a statutory complaint for land to recover land lot'‘No. 738 in the 1st district and 4th section of Haralson county, and the mesne profits thereof. A verdict was rendered, making, among other findings, one for the plaintiffs for four fifths of the premises in dispute; and the defendant), who is the plaintiff in error in this .court, filed exceptions to the overruling of his motion for a new trial.
