Appeal is from judgment on a jury’s verdict finding that Bert A. George sustained pulmonary disability while working for Chicago Bridge and Iron Company on premises provided by Aluminum Ore Company near Benton. To reverse the awarding of $40,000 appellants contend (a) that the Ore Company owed no affirmative duty to an employe of Chica,go Bridge and Iron Company; (b) appellee assumed the risk; (c) proximate cause of the injury was not an event or incident set in motion or released by appellants; (d) defendants were prejudiced by plaintiff’s act in excusing certain…
