Appeal by the defendant, Catharine Haverty, as administratrix, etc., from an order of the Appellate Term of the Supreme Court, entered in the office of the clerk of the county of Hew York on the 4th day of May, 1911, affirming a final order and judgment of the Municipal Court of the city of Hew York in a summary proceeding for the removal of a tenant.

The lease under which the proceedings to dispossess the tenant were instituted was made on the 1st day of March, 1906, between the plaintiff and one James T. Haverty, since deceased, *565and was for the use of the building known as 150 East Thirty-ninth street, with the appurtenances, for the term of three years from May 1, 1906, at an annual rental of $2,500, payable in equal monthly installments in advance, on the first day of each month; and on the 16th day of September, 1907, by an indorsement on the lease duly made by the parties, the term was extended to May 1, 1912, at an…
