On November 29,1984, The Bank of New York (BONY), plaintiff herein, filed this suit against four defendants, Russell L. Hoyt, R. Perry Harris, Herbert L. Finley, and Radcliffe L. Romeyn, Jr. In its eight count complaint, BONY alleged that the defendants were jointly and severally liable for the payment of a certain mortgage note (Note) by reason of their respective affiliations with the partnership obligor and in their capacity as guarantors.
