This is an action by Sutherland & Co. against the city of Nashville for damages. There was a trial before the Court below and a jury, and a verdict and judgment for' $1,768, and the city has appealed.

Sutherland & Co., in 1888, were the owners of certain property in Nashville, situated on the east side of the Cumberland River, on which was located a lumber yard and planing mill. Adjacent to this property was a pool or pond of stagnant water, which the Mayor and City Council, through the Board of Public Works and Affairs, desired to drain by means of a sewer-pipe, leading to the river through…
