This was an action in ejectment by appellants to recover ten acres of land. There was a special finding of facts and conclusions of law in favor of appellees, upon which judgment was rendered. The errors assigned are the action of the court in overruling appellants' motion for a new trial, and in the conclusions of law. It appears by the special findings that Jacob Coil, a resident of Marion county, Indiana, died testate in said county sometime prior to January 16, 1838.
