Petitioner Korey Liggins (“Liggins”), who is currently incarcerated at Elmira Correctional Facility in New York (“Elmira”), seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254 against John Burge, Superintendent of Elmira (“Respondent”). Liggins was convicted in New York State Supreme Court, New York County (the “Trial Court”) of murder in the first degree, in violation of New York Penal Law § 125.27(1), and attempted robbery in the first degree, in violation of New York Penal Law §§ 110.00, 160.15[2].
