Potter, Chief Justice.

This is a proceeding in error for the review of a judgment rendered upon the verdict of a jury for the plaintiffs in an action of trespass, including punitive as well as compensatory damages. A question of practice is presented upon a contention of defendants in error that the matters discussed in the brief for plaintiffs in error are not properly before the court for consideration. That is based chiefly upon the procedure below following the verdict. The verdict was received on December 1, 1920. On the next day the defendants filed a motion “to set aside the verdict”…
