MEMORANDUM & ORDER

GORTON, District Judge.

This case involves an insurance dispute arising from a flood at the Beth-Israel Hospital in Boston in 2004. After paying a claim, the hospital’s insurance carrier, as subrogee, brought this lawsuit against water and electric utilities maintaining equipment near the hospital. One of the defendants now moves for summary judgment with respect to the plaintiffs First Amended Complaint.
