In this ease the appellee sued the appellant as workmen’s compensation insurance carrier of Walter H. Denison, alleging that he was totally and permanently disabled as a re-suit of injuries received in the scope and course of his employment by said Denison. The trial was before the court without a jury. Judgment was rendered in favor of appellee in the sum of $5,102.89 and costs of court.

The appeal is based upon three alleged errors, which will be taken up in the order presented.
