This is a mandamus action. Plaintiff seeks the return of personal property seized in his apartment by the Detroit police. The trial judge denied the writ.

On February 26,1963, about 4:30 a.m., a cab driver reported to the police department. He stated he was approached by a man about 25 years of age. •He drove the man to an alley where the passenger got out, returning shortly with a new white sidewall tire and wheel.
