Michael W. Gobble, defendant herein, was convicted after a jury trial of attempted stealing without consent, § 564.011, RSMo 1978, and sentenced as a prior offender to three years imprisonment in the Missouri Department of Corrections. § 558.011, RSMo 1978. On appeal he briefs five points which essentially raise only three issues: 1) the evidence was insufficient to support his conviction; 2) the trial court erred in refusing to instruct on tampering in the second degree, property damage in the third degree, or trespass in the second degree as lesser included…
