This is an action brought by the assignee of a conditional sale agreement to recover the amount of a deficiency resulting from the repossession and resale of a motor vehicle.

The defendant and Milford Auto Sales, Inc., entered into a retail instalment contract on September 6, 1958, for the sale of a 1958 Chrysler automobile. The time balance owed by the defendant under the contract was $5087.02. Subsequently, the plaintiff became the assignee for value and holder of the contract.
