MEMORANDUM
RAPOPORT, United States Magistrate Judge.
Presently before this Court is the Motion for Summary Judgment filed by Defendants Hamburg Area School District (“School District”) and Joseph Padasak (collectively, “Moving Defendants”) pursuant to Federal Rule of Civil Procedure 56©, and the Response, Reply and Sur-Reply filed thereto. For the reasons that follow, the Motion will be granted, and Counts II and TV of the Complaint will be dismissed.
