MEMORANDUM OPINION
WALTON, District Judge.
The plaintiff, Terry Newborn, brought this action against Yahoo! Inc. and Google Inc. (“the defendants”) for copyright and trademark infringement in violation of the Copyright Act, 17 U.S.C. §§ 101 et seq. (2000), and the Lanham Act, 15 U.S.C. §§ 1117 et seq. (2000). 1 This Court granted the defendants’ motion to dismiss the plaintiffs complaint for failure to state a claim and dismissed the case with prejudice. Newborn v.
