This declaratory judgment action raises issues regarding an insurer’s (1) responsibility to indemnify for costs arising out of a hazardous waste cleanup and (2) duty to defend its insured during the dispute related to that cleanup. Plaintiffs A. Johnson & Co., Inc. and its subsidiary A. Johnson Energy Marketing, Inc. (collectively “Johnson”) incurred substantial costs in connection with the cleanup of a hazardous waste site in Maine.
