Order unanimously modified, on the law, and as modified, affirmed, without costs, in accordance with the following memorandum: Plaintiff, an employee of World Auto Parts, Inc. (World), was injured when he fell from a warehouse loft. The building was owned by the five defendants and was leased to World. The five defendants were directors and shareholders of World, and defendants Pellitieri, Labenski and Gambino were also officers and employees. Plaintiff had been instructed to build a floor in the loft that would be adequate in size for storage of some 5,000 empty boxes. After three sections…
