This case arises out of a Freedom of Information Act [hereinafter “FOIA”] request which Plaintiff Public Employees For Environmental Responsibility, Rocky Mountain Chapter, made of Defendant United States Environmental Protection Agency [hereinafter “EPA”]. Plaintiff claims defendant improperly withheld certain documents encompassed in its FOIA request.
