After the trial of a complaint for an equitable division of marital property brought by Judith Pare (wife) against David Pare (husband) pursuant to G. L. c. 208, § 34 (1989 Supp.), 1 a judge of the Probate and Family Court entered a judgment dividing the parties’ interests in the marital home. The wife appealed from the judgment, and we transferred the case to this court on our own motion. We conclude that the judge erred in dividing the property as he did, and that he should address another issue raised by the wife.
