The petitioners, four uniformed firemen of the Fire Department of the City of New York, have instituted this proceeding under article 78 of the Civil Practice Act to enjoin the Fire Commissioner from enforcing Special Order No, 258 issued by him on December 20, 1943.

This special order substantially provides that all uniformed members of the Department shall serve three additional eight-hour tours of 11 added duty ’ ’ in every twenty days. -.This would represent an increase of eight hours weekly over the usual time requirements of the “ three platoon system ” as set forth in section 487a-11.0…
