Affirming.

One Cawood was indebted to Sid Lewis in the sum of $4,000,_ evidenced by Ms promissory note. Lewis obtained judgment. Oawood executed a replevin bond wMch was not satisfied. Lewis, through his attorney, caused an éxecution to issue, which was placed in the hands of the sheriff on December 1, 1928. On December 12th the sheriff levied upon a stock of goods belonging to Oawood, and advertised it for sale. It was sold later in December, when the appellant, J. W.
