The appellant, Anita Montecino, charged with having murdered one Encarnación Mata, waived her right to a jury trial and was found guilty by the court of the crime of manslaughter, a lesser offense included in the original charge against her. Her applications for a new trial and for probation were denied and she was sentenced to imprisonment in the California Institution for Women at Tehachapi.
