On April 30, 1890, the appellant, Patrick Hagan, executed a title hond to S. E. Taylor, C. P. Planary and George C. McElroy for the sale of lots 10, 11, 21 and 22, of Block 17, and lot 1 of Block 11, in the town of West Horton, Wise county, Virginia, “as run by A. Thompson,” at the price of $2,000, to be paid in six and twelve months with interest; and when paid the vendor agreed to convey a good title to the vendees. The following endorsement appears on the contract:

“C. P. Planary and Geo. C. McElroy have paid their proportion of the above purchase money on said lots. I am to deliver them a…
