In September, 1890, Gilliam and others procured an option for sixty days from Hilliard upon a parcel of land situated in the *736city of Norfolk at the price of $65,000. They afterwards associated with themselves the owners of other tracts of land in the said city, all of which parcels were to be sold to a joint stock company, which they proposed to organize.
