OPINION AND ORDER OF THE COURT SUSTAINING DEFENDANTS’ MOTION FOR SUMMARY JUDGMENT
THEIS, District Judge.
This case is presently before the Court on defendants’ motion for summary judgment, based originally on a claim of res judicata and estoppel as a result of a decision of the Fourth Circuit Court of Appeals holding plaintiff’s patents invalid, and subsequent action of the United States Supreme Court denying certiorari.
