WEINFELD, District Judge.

The relator brings this writ of habeas corpus to secure his release from Ellis Island, where he is being detained pending his deportation. He has been in custody since June 19, 1953, following his arrest on an immigration warrant charging him with membership in the Communist Party after his entry into the United States. 1 A prompt hearing was had, and on July 9, 1953, an order was entered sustaining the charge and directing his deportation.
