The Appellant Elmer David Miller was convicted of a misdemeanor and probated for the two-year statutory maximum on the condition that he attend counseling recommended by the Office of Probation and Parole. That office ' recommended that he enroll in the state’s three-year sex offender treatment program required for felony sex offenders.
