RITCHIE, District Judge.
This action was brought in the district court of Juab county by the plaintiff to quiet its title to 10 unpatented mining claims, which are referred to as the “A. B. C. group.” The sufficiency of the locations made by the plaintiff is not challenged, except as to the question whether the property covered by these locations was open to entry at the time the property was located by the plaintiff.
