Before this court are Defendants’ Motion for Summary Judgment and Plaintiffs Cross Motion for Partial Summary Judgment. For the reasons which follow, the Defendants’ Motion for Summary Judg*352ment will be granted in part and denied in part, and Plaintiffs Cross Motion for Partial Summary Judgment will, be granted.
