Appeal from a judgment of the superior court for Adams county, Truax, J., entered February 23, 1918, upon findings in favor of the plaintiff, in an action on contract, tried to the court.

This suit was commenced in Adams county. It is based upon a claim, to the extent of the purchase price, for the breach of an alleged warranty, made by appellant through an agent, that a combined harvester machine sold to plaintiff in Adams county would do good work. The summons was served by the sheriff, so his return shows, by delivering to M. G. Priddy, in said county—he being the agent of defendant corporation—a true copy of the summons and complaint, on October 1, 1917.
