The plaintiff, Donald G. Mclsaac, seeks to resurrect his personal injury action against the defendant, Ronald D. Cedergren, which was dismissed when the plaintiff’s counsel failed to serve the complaint in a timely manner. Plaintiff’s counsel avers that his secretary sabotaged his legal practice and blames her for both his failure to serve the complaint and his delay in filing a motion pursuant to Mass.R.Civ.P. 60(b)(1), 365 Mass. 828 (1974).
