J. PAUL OETKEN, District Judge:

Plaintiff Forest L. Fate, Sr. (“Fate”) brings this- action under 42 U.S.C. § 1983 against the Village of Spring Valley, New York (the ‘Village”) and Officers Ronnie Charles (“Charles”), Christopher Korba (“Korba”), and Khalid Parwanta (“Parwan-ta”) for alleged constitutional violations arising out of an arrest and search on October 31, 2009. Fate asserts Fourth Amendment claims for unreasonable search, illegal seizure of currency, malicious prosecution, and excessive force.
