The Appellant in September last, obtained a judgment in the District Court for Ramsey County, against the Minneapolis and Cedar Yalley Rail Road Company, for the sum of $2781,90. During the pendency of *394that suit, an action was commenced against Henry H. Sibley, as garnishee of said Hail Boad Company, the summons requiring him to appear and answer thereto on the 12th of September, 1859. The answer!] disclosed inter alia the following facts, viz:
