delivered the opinion of the court:
Thomas F. Mack, receiver in the matter of Elizabeth Mack against James Nolan and others, instituted suit on a policy of fire insurance against the Liverpool and London and Globe Insurance Company, Ltd., a corporation, in the circuit court of Mercer county. The defendant filed a general and special demurrer to the amended declaration. The demurrer was overruled and the defendant elected to abide by it.
