The defendant, Rickey Preston Mullís, appeals his conviction by a jury of the offense of driving an automobile under the influence of alcohol in violation of OCGA § 40-6-391 (a) (4).

The evidence shows the defendant lost control of his truck and swerved off the road into the yard of a private residence, damaging the resident’s automobile and other personal property. Within five minutes after hearing the crash and seeing a truck leave the scene with a flat tire, a nearby resident called the police at 9:55 p.m. to report the accident.
