L. M. Sumner was indicted for the murder of James Powell, and was found guilty of the offense of voluntary manslaughter. Plis motion for a new trial was overruled by the presiding judge, and he excepted to that decision.

*1431. One ground of the motion alleges error because the court gave in charge to the jury the law of voluntary manslaughter; and inasmuch as the verdict was for voluntary manslaughter, this ground will be considered in connection with the first two grounds, that is, that the verdict was contrary to law and the evidence.
