FINDINGS OF FACT AND CONCLUSIONS OF LAW AND ORDER

SILVER, District Judge.

I. INTRODUCTION

This is a Petition for Habeas Corpus and Motion for Temporary Restraining Order filed by Ramon Mendez-Ruiz (“Petitioner” or “Mendez”). Mendez, a native and citizen of Mexico, entered the United States illegally after having been previously deported pursuant to an Order that was entered and executed on July 17, 1987.
