In an action to recover damages for personal injuries, the plaintiff appeals from an order of the Supreme Court, Kings *679County (Kramer, J.), dated January 27, 2006, which granted the defendants’ motion for summary judgment dismissing the complaint and denied his cross motion for summary judgment on the issue of liability under Labor Law § 240 (1).

Ordered that the order is affirmed, with costs.
