Plaintiff in error was tried in the Criminal Court of Cook county, at the November term, 1880, upon an indictment charging him with the murder of Etta Carl, in attempting to produce an abortion. The jury acquitted him of the charge of murder, but convicted him of an assault with intent to produce an abortion, and fixed the time of his confinement in the penitentiary at five years, and he ivas duly sentenced by the court, in pursuance of the verdict. Plaintiff in error asks a reversal of this sentence on several grounds, but mainly because it is not supported by the evidence. There is but…
