Ronald S. Dennis appeals his convictions and sentences for aggravated rape, under section 566.030, RSMo 1986, and first degree assault, under section 565.050, RSMo 1986. On appeal, Mr. Dennis argues that the trial court erred in instructing the jury, accepting the jury’s verdict, and sentencing him for both first degree assault and aggravated forcible rape in violation of his right to be free from double jeopardy because first degree assault is a lesser-included offense of aggravated forcible rape.
