MEMORANDUM OPINION
ANDREWS, U.S. District Judge:
Plaintiff Matthew N. Jones, who appears pro se, filed this action on June 6, 2016. (D.I. 1).1 Defendant moves to dismiss pur*835suant to Fed. R. Civ. P. 12(b)(1) and 12(b)(6) and, in turn, Plaintiff moves for summary judgment. (D.I. 4, 8). Briefing on the motions is complete.
BACKGROUND
