SADLER, Justice.

We are asked to determine the constitutionality of section 6 of the Uniform Criminal Extradition Act, 1941 Comp. § 42-1906 and, if sustained as against the challenges urged touching its validity, its applicability to the grounds for petitioner’s detention.

The facts are simple and not in dispute. The petitioner is held in custody by the sheriff of Chaves County, New Mexico, on a warrant of extradition issued by the Governor of New Mexico at the request of the Governor of California seeking the prisoner’s return to that state to answer the charge of “Failure to Provide for Minor…
