This is an action to redress alleged violations of § 10(b) 1 of the Securities Ex change Act of 1934 and § 12(2) 2 of the Securities Act of 1933. Currently before the court is the motion for summary judgment of National Bank and Trust Company (“National Bank”), a defendant and third-party defendant.
