In this action of trespass on the case instituted by Eleanor Niland (now Higgins) against Monongahela West Penn Public Service Company for recovery of damages for personal injuries sustained by her on August 2, 1924, in a collision between an automobile owned and operated by William E. Gregg, in which plaintiff was riding as a guest passenger, and defendant’s trolley work car, the Circuit Court of Marion County overruled a demurrer to the evidence interposed by defendant and entered judgment for plaintiff upon the jury’s conditional verdict of $8,000.00.
