MEMORANDUM OF OPINION AND ORDER

Before the Court is the Motion to Dismiss Creditor’s Complaint as Untimely Filed (the “Motion”) submitted by the Debtors and Defendants, Dale and Alice Hannen (“Debtors” or “Debtor-Defendants”), over the objection of the Creditor, Richard Zabivnik (“Creditor” or “Plaintiff’). Such relief is sought pursuant to Federal Rule of Bankruptcy Procedure 4007. Fed. R. Bankr.P. 4007.
