Nelson Mortgage Company, a corporation, brought this suit against Grant E. Lovett and Commercial Standard Insurance Company, a corporation, to recover items of indebtedness representing the sale price of citrus fruit purchased by Grant E. Lovett as a “dealer” under the provisions of Vernon’s Ann.Civ.Statutes, Art. 118b. The suit as against Commercial Standard Insurance - Company, the surety upon the bond of said dealer, provided for in section 4(b) of said Art. 118b, was upon' the said bond.
