The facts on which the question arises are particularly set forth in the case stated. It is agreed, that unless the plaintiffs, under the circumstances, had a right of stoppage in transitu, the assignee is entitled to the money. Without entering into a general discussion of the law of stoppage in transitu, it may be sufficient to observe, as a preliminary remark, that as between the original consignor and consignee, it is now clear, that the consignee-has a right to seize the goods in their transit or passage from the consignor to the…
