This is an appeal upon the judgment-roll. A judgment was rendered against defendants Wade and Mason for the amount of rent which they had collected from subtenants of real property belonging to the plaintiff.

The facts are complex and we quote from the findings of the court only those which are pertinent upon this appeal. On June 22, 1909, the owners of a certain two-story and basement building, situated at Eddy and Market Streets, San Francisco, California, entered into a lease of the same to William B. Pringle.
