NEWMAN, Circuit Judge:

In United States v. Myers, 635 F.2d 932 (2d Cir.), cert. denied, 449 U.S. 956, 101 S.Ct. 364, 66 L.Ed.2d 221 (1980) (Myers I), we ruled that the Government had not violated the defendant’s constitutional rights as a Member of Congress by requiring him to stand trial on charges of bribery arising out of an undercover “sting” operation now well known to the nation as Abscam. See also United States v. Murphy, 642 F.2d 699 (2d Cir. 1980). The Myers ruling, made in advance of trial, was based on the face of the indictment that had been returned.
